Chapter 18

When Kevin Riley and his wife Vanessa were brought before Judge Ryman later that morning, he told the judge that the breathalyzer proved he had not been drinking, so there was no reason for Tommy Frost to arrest him, which meant that there was no case.

“No, sir,” the judge told him. “The breathalyzer does show that you had been drinking. Just not to the point of intoxication.”

“Either way, there’s no case if I wasn’t drunk.”

"Where did you go to law school, Mr. Riley?"

“Law school? I never went to law school."

“It shows,” the judge told him. "You're not charged with DUI. You are charged with five open container violations, reckless driving, resisting arrest, and interfering with a police officer. How do you plead?"

“How can that hold up? How can I be charged with resisting arrest if I didn’t do anything wrong to get arrested in the first place?"

“Again, Mr. Riley, where did you go to law school?"

The man did not reply. He just shook his head.

"You have two choices, sir. You can enter a plea, and we can deal with it here, or I can set bail, and you can come back in, let me see,” the judge referred to his calendar and said, “37 days, and I will adjudicate the case then. If you decide on that route, I strongly urge you to hire an attorney who actually did go to law school, sir. Which is it going to be?"

“Can you tell me what the fine will be?"

“I can tell you that the more you argue with me, the more it's going to be,” the judge said. “Make a plea or ask for bail. What's it going to be, sir?"

“I can't afford to lose my license, Your Honor. I’ll lose my job if I do."

"You should have thought about that before you got in the car with alcohol yesterday morning," the judge said. “What’s it going to be, sir?"

“I guess I plead guilty."

“This isn’t a TV game show, Mr. Riley. You can’t guess."

“Then, I plead guilty."

“All right,” Judge Ryman said. “I'm sentencing you to thirty days in jail, with credit for one day served, a $1450 fine, and I'm suspending your license for one year. However, because I understand that you need your license for work, I will grant you a provisional license. That means you can drive to work and back home, and you can drive a vehicle if required while on the job. But that's it, Mr. Riley. If you go to the grocery store or Walmart or anyplace else and you get stopped, you will be driving on a suspended license. If that happens, you can kiss your license and your job goodbye. Do we understand each other?"

“Is that the best you can do?"

“No, that's not the best I can do," the judge replied. “I can suspend your license and not give you a provisional license. I can give you almost twice as much in fines and more jail time. Do you feel like rolling the dice, sir?"

“No,” Riley said, shaking his head.
